1. Agreement to Terms
By using videoArchiver ("the Service"), a product of Kannah Consulting, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Description of Service
videoArchiver provides a Ring camera video clip archiving service that links your Ring account and automatically transfers clips to your third-party cloud storage (Google Drive, with Dropbox and Amazon S3 planned). videoArchiver does not store, retain, or copy any video footage on its own infrastructure. Clips are streamed directly from Ring's servers to your configured cloud destination.
3. User Responsibilities
You are responsible for maintaining the security of your videoArchiver account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to or use of your account. You are also responsible for ensuring that your use of the Service complies with the terms of service of any third-party platforms you connect, including Ring and your chosen cloud storage provider.
4. Third-Party Services and Trademarks
The Service integrates with third-party platforms including Ring (Amazon.com, Inc.), Google Drive (Google LLC), Dropbox (Dropbox, Inc.), and Amazon S3 (Amazon Web Services, Inc.). Ring is a registered trademark of Amazon.com, Inc. All other trademarks are the property of their respective owners. videoArchiver is not affiliated with, endorsed by, or sponsored by Ring, Amazon, Google, Dropbox, or any other third-party service provider. Your use of these third-party services remains subject to their respective terms of service and privacy policies.
5. Acceptable Use
You agree not to use the Service to archive content that violates applicable laws or infringes on the rights of others. You agree not to attempt to circumvent any security measures, rate limits, or access controls of the Service. We reserve the right to suspend or terminate access to the Service for violations of this section at our sole discretion.
6. Subscription and Billing
The Service offers a free tier with usage limits as described on our pricing page. Paid subscription plans are billed through the Ring Appstore and subject to Ring's billing terms. Subscription fees are non-refundable except as required by applicable law. Free tier users who exceed their event limits may experience interrupted service until the next billing cycle.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KANNAH CONSULTING, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF DATA, LOST PROFITS, LOSS OF REVENUE, OR BUSINESS INTERRUPTION ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. WE DO NOT GUARANTEE THAT ALL RING CAMERA CLIPS WILL BE SUCCESSFULLY ARCHIVED, AS THE SERVICE DEPENDS ON THIRD-PARTY APIs AND SERVICES BEYOND OUR CONTROL.
9. Indemnification
You agree to indemnify, defend, and hold harmless Kannah Consulting and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party right, including any intellectual property or privacy right.
10. Service Availability and Modifications
We reserve the right to modify, suspend, or discontinue the Service or any feature at any time with reasonable notice. We may update these Terms from time to time. Material changes will be communicated via email to the address associated with your account. Continued use of the Service after modifications constitutes acceptance of the updated Terms.
11. Termination
You may terminate your account at any time from the Service dashboard. Upon termination, you may request deletion of your account data in accordance with our Privacy Policy. We may suspend or terminate your account if you violate these Terms or if your account remains inactive for a period exceeding twelve months. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to limitation of liability, disclaimer of warranties, and indemnification.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States and the jurisdiction in which Kannah Consulting operates, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration where required by applicable law.
